With the Travel Protected insurance policy you are covered even while traveling. In fact, the indemnity covers any damage caused unintentionally to third parties, property and people.

Traveler's liability policy, here's what it provides

Is an accident likely to ruin your vacation and more? If you've taken out Barbarhouse and UnipolSai's Travel Protected policy on your side, you'll have a friendly hand coming to your aid. Traveler's Liability coverage provides that the Company is obligated to hold the insured harmless from the payment of compensation due for damages for which it is civilly liable.

This liability, as provided by law, covers compensation for principal, interest and expenses on damages caused to third parties unintentionally, by death, personal injury or damage to property, as a result of an accidental occurrence while traveling in the insured's private life.

The Maximum Limits for Traveler's Liability.

By taking out our agency's travel insurance, the traveler's liability guarantees are provided up to the maximum amount of Euro 15,000.00 per event, for the entire duration of the trip.

The maximum amount established in the Travel Protected policy remains single, for the damage to which the claim relates, even in the case of co-responsibility of several insured persons.

The territorial extension of the policy

The insured's liability indemnity applies to all countries. However, actions brought against the insured in Canada and the United States of America are excluded.

Traveler's Liability: what are the Exclusions

Not all damages caused to third parties are covered by Travel Protected insurance in the area of Traveler's Liability. As underwritten at the time of the contract, "The following damages are excluded from the guarantee :

Litigation management and resistance expenses

The Company assumes the management of disputes as long as it has an interest in them, both out-of-court and in court, both civil and criminal, on behalf of the insured traveler.

If necessary, the Company designates attorneys or technicians and avails itself of all rights or actions pertaining to the insured, who is obliged to cooperate in order to enable the management of disputes and to appear in person in court if required by the proceedings. The Company shall have the right to recourse against the insured for the prejudice resulting from failure to comply with the above obligations.

Expenses incurred in resisting the action brought against the insured traveler shall be borne by the Company: the limit of the amount of expenses is equal to one-fourth of the maximum amount established in the policy for the damage to which the claim relates. Should the amount owed to the injured party exceed the maximum amount, the expenses shall be shared between the Company and the insured in proportion to their respective interests.

The Company does not recognize the insured for expenses incurred for attorneys or technicians who are not appointed by the Company, nor is the Company liable for fines or penalties nor for criminal court costs.

Deductible/discount

With regard to damage to property and animals, the insurance for each claim is provided with the application of a deductible on the indemnifiable damage equal to 10%, with a minimum of Euro 100.00.

Provisions and Limitations

The Traveler's Liability coverage under the Protected Travel policy is provided on a second-risk basis with respect to any other liability policies operating to guarantee the same risk.

What to do in the event of a claim?

The traveler insured under Barbarhouse and UnipolSai's Viaggi Protetto policy must make a written report in the event of a claimwithin 3 days of becoming aware of it. The report should be forwarded to: UnipolSai Assicurazioni S.p.A. - Tourism Claims Office - Via della Unione Europea, 3/B - 20097 San Donato Milanese (MI).

In addition, the insured must immediately send to the Company any form of order, warrant, subpoena or other legal document it has received pertaining to any claim to the address: UnipolSai Assicurazioni S.p.A. - Tourism Claims Office - C.P. 78 - 20097 San Donato Milanese (MI).

Failure to comply with this obligation may result in the partial or total loss of the right to indemnity. In accordance with the provisions of Article 1915 of the Civil Code, the insured traveler shall not acknowledge his liability or enter into transactions of any kind without first receiving the approval of the Company.
